What exactly is a Section 8 Notice?
A Section 8 Notice is served on the tenant by you (the landlord) wishing to regain possession of a property during an Assured Shorthold Tenancy (AST) and you must have a ground (basis) to serve the notice. These grounds are set out in the Housing Act, only those specified in the Housing Act are applicable.
A Section 8 Notice can only be issued to a tenant who has breached the terms laid out in the fixed term tenancy agreement or broken the law. You cannot evict a tenant without first obtaining an order for possession from a court. You must serve a Section 8 Notice to quit on the tenant stating the ground or grounds on which the possession is sought before applying to the court, some grounds are discretionary and will require a court’s opinion; some are mandatory and entitle the landlord to evict the tenant with no dispute.
